F.A. DAVIS COMPANY (“F.A. Davis”) is the owner and operator of the Davis PT Network website (“DavisPTnetwork Site”) located at the URL www.davisptnetwork.com. F.A. Davis is committed to protecting the privacy and security of the information it may gather from Users.

This Privacy Policy explains F.A. Davis’ policy regarding the collection, use and disclosure of your personal information. As F.A. Davis updates and expands its products and services offered via the DavisPTnetwork Site, this Privacy Policy may be modified or revised, so please refer back to it periodically. By accessing our DavisPTnetwork Site or using F.A. Davis’ services, you consent to our information practices and this Privacy Policy. This Privacy Policy is incorporated completely into the Terms of Use. By using the DavisPTnetwork Site, you agree to all terms and conditions of the Terms of Use, which is incorporated herein by reference.

DEFINITIONS

The term “CE Information” shall refer to Personal Information shared with third parties for the purpose of obtaining or verifying continuing education credits.

The term “CE Course(s)” means continuing education courses offered by, through or via the DavisPTnetwork Site.

The term “Course Administrator” shall refer to the person, company or authority administering a CE Course.

The term “Content” refers to all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials posted at, on or to or at the DavisPTnetwork Site.

The term “F.A. Davis” refers to F.A. DAVIS COMPANY.

The term “Parties” shall refer to F.A. Davis and User, collectively.

The term “Party” shall refer to either of F.A. Davis or User.

The term “Payment Information” shall refer to credit card payment information provided by a User to F.A. Davis for payment of a CE Course.

The term “Personal Information” includes, but is not limited to, any information that identifies or describes an individual, including his or her name, professional licensing information, social security number, physical description, age, gender, marital status, health status, financial status, home address, home telephone number, education, financial matters, and medical or employment history. Personal Information also includes statements made by, or attributed to, a User.

The term “DavisPTnetwork Site” refers to the Davis PT Network website accessible through the URL www.davisptnetwork.com.

The term “User Profile” refers to a profile posted by a User on the DavisPTnetwork Site.

The terms ''you'', “your” and/or ''User'' refer to any individuals and/or entities visiting and/or otherwise accessing the DavisPTnetwork Site for any reason.

PERSONAL INFORMATION COLLECTED AND USE OF PERSONAL INFORMATION

Information about you is collected at or via the DavisPTnetwork Site when you: (i) register for the DavisPTnetwork Site; (ii) enter your Personal Information in any form on the DavisPTnetwork Site; (iii) apply for or register for any CE Course offered by or via the DavisPTnetwork Site; (iv) post or otherwise enter Personal Information in a User Profile; (v) purchase a publication available through the DavisPTnetwork Site; (vi) sign up for any e-mail alerts or communications; or, (vii) enter a contest or other promotional feature. Personal Information may also be collected any time a User provides such information voluntarily to F.A. Davis via the DavisPTnetwork Site or any form thereon. Personal Information is provided at your own risk. F.A. Davis will not collect any Personal Information about you unless you agree to disclose such information personally.

By providing your Personal Information, you are communicating your consent to F.A. Davis’ collection, use and disclosure of such Personal Information for the purposes for which you provided the information to F.A. Davis, and as described in this Privacy Policy. You will, at some points during the collection of Personal Information, and from time to time, be given the option of "opting out" of or "opting in" to F.A. Davis’ collection, use and disclosure of your Personal Information for certain purposes by signing a form, “checking” a box on a form, clicking on an icon or hyperlink (or via a similar method) on the DavisPTnetwork Site, or by contacting F.A. Davis as described below in this Privacy Policy. If you do not want F.A. Davis to collect your Personal Information or use it for purposes other than as necessary to fulfill your request, please use the "opt out" option so that your information is not collected or used. If you have submitted Personal Information to F.A. Davis and wish to later opt out or withdraw your consent to its retention, use or disclosure, please contact F.A. Davis using the methods described below. You may opt out or withdraw your consent, subject to legal or contractual restrictions, at any time and upon reasonable notice.

Users will have the option to elect to “opt out” from any or all of the following communications from F.A. Davis: (1) Mail (e-mail and direct mail); (2) Phone (telephone and fax solicitation); or (3) Contact (all communications including e-mail, direct mail, fax and telephone). In addition, Users can “opt out” of further e-mail communications by following the directions included in e-mail communications or by visiting the DavisPTnetwork Site using the “edit account” section after you login.

Users acknowledge and agree that all agreements, notices, disclosures and other communications that F.A. Davis provides to you electronically either via our DavisPTnetwork Site or through e-mails satisfy any legal requirement that such communications be in writing. You may "opt out" of receiving such communications by sending an e-mail message with the word Unsubscribe in the subject line to fadavis@davisptnetwork.com.

The DavisPTnetwork Site permits Users to submit contact information, should they so choose. Submitted information may be used to contact Users to answer questions and send information about the DavisPTnetwork Site, or programs offered by, through or via the DavisPTnetwork Site. Users may also be contacted regarding participating in surveys. Information gathered from Users during surveys is only gathered in order to learn more about general User preferences, trends and interests. Users may “opt out” of such contact by following the directions included in e-mail communications or by visiting the DavisPTnetwork Site and following the “opt-out” instructions.

F.A. Davis may collect data about how the DavisPTnetwork Site is searched to enable F.A. Davis to understand and respond to the needs of Users. This data does not contain Personal Information. Users can visit the publicly accessible areas of the DavisPTnetwork Site without identifying themselves or disclosing any Personal Information.

A "cookie" is a bit of information that a DavisPTnetwork Site sends to your internet web browser that helps the DavisPTnetwork Site remember information about you and your preferences. The DavisPTnetwork Site may use cookies to improve the overall DavisPTnetwork Site experience. Cookies generally do not permit personal identification of a User. A User can set their internet web browser to notify them before they receive a cookie, giving each User the chance to decide whether to accept the cookie. A User can also set their internet web browser to turn off cookies. If you do so, however, some portions of the DavisPTnetwork Site may not function properly.

Content posted on blogs will be made available to third party websites such as through RSS feeds. By posting Personal Information on a blog or as part of a blog entry, you agree that such Personal Information may be provided to third party websites such as through RSS feeds. You should keep in mind that, although it may be possible to “unpublish” Personal Information posted on or as part of a blog on the DavisPTnetwork Site, it is not possible to “unpublish” Personal Information made available to and published on third party websites.

You should keep in mind that, if you refuse to consent to, opt out of, or withdraw your consent to our collection, use and/or disclosure of your Personal Information that is necessary to fulfilling your request, we may not be able to offer you certain goods, services and/or benefits.

Unless you opt out using the procedures outline in this Privacy Policy, F.A. Davis may use your personal information for, among other things, sending promotional e-mails and e-mail newsletters to the e-mail address you provide.

F.A. Davis may share Personal Information, such as CE Information, with third parties, as outlined in this Privacy Policy.

F.A. Davis will not sell, rent or lease User names, lists of Users, or User contact information.

PERSONAL INFORMATION POSTED IN USER PROFILES

Although F.A. Davis allows you to set privacy options that limit access to your User Profile, it is important that you appreciate that no security measures guarantee absolute privacy or safety. F.A. Davis cannot control the actions of other Users with whom you may choose to share your Personal Information.

F.A. Davis cannot and does not guarantee that Personal Information you post on the DavisPTnetwork Site will not be accessed by unauthorized persons. F.A. Davis is not responsible for circumvention of any privacy settings or security measures of the DavisPTnetwork Site. You understand and acknowledge that, even after removal, copies of Personal Information on User Profiles may remain viewable in cached and archived pages or if other Users have copied or stored your Personal Information.

You may post and display Content including Personal Information as part of your User Profile at your discretion. You will have the opportunity to select how you share such Personal Information by editing the privacy settings available in connection with User Profiles to your desired preferences. You are solely responsible for your privacy settings, and F.A. Davis is not and will not be responsible for Personal Information shared by you via a User Profile or the settings associated therewith.

CE INFORMATION COLLECTED AND USE OF CE INFORMATION

Some of the CE Courses offered via the DavisPTnetwork Site are offered by third party Course Administrators. F.A. Davis is required to collect and share certain CE Information with third party Course Administrators for the purpose of verifying CE Course credits, and so that you will obtain CE credits.

When you register to take online CE Courses, the registration process requires that you provide certain CE Information so that you may obtain any sought after CE credits. This information is necessary for Course Administrators to process your participation in CE Courses and to process any sought after CE credits. CE Information may include, but may not be limited to: your name and address; information relating to the CE Course you completed; the date you completed a CE Course; your license number. Users who have questions as to the specific data to be provided in any given case, should contact F.A. Davis at customerservice@davisptnetwork.com before registering for a continuing education program or test.

By participating in any CE Course offered via the DavisPTnetwork Site, you agree that F.A. Davis may collect and use any CE Information you provide, including transmitting such CE Information to third party Course Administrators.

User taking CE Courses via the DavisPTnetwork Site will have been given a CE Password. This CE Password will be connected to CE Information required for identification of the User as may be required by the Course Administrator

F.A. Davis may be required by third party Course Administrators to maintain CE Information for several years. By enrolling in and/or participating in a CE Course via the DavisPTnetwork Site, you agree that F.A. Davis may maintain this CE Information.

PAYMENT INFORMATION

You will be required to submit Payment Information in order to sign up for and participate in CE Courses. F.A. Davis utilizes such Payment Information for the purpose of processing payments and competing CE Course transactions. F.A. Davis does not retain such Payment Information after the completion of a transaction.

SECURITY OF YOUR PERSONAL INFORMATION

The DavisPTnetwork Site takes precautions to protect Personal Information. When you submit sensitive Personal Information via the DavisPTnetwork Site, the information is protected both online and off-line.

When you place orders or access your account or profile, F.A. Davis offers the use of a secure server. The secure server software (SSL) encrypts all information you input before it is sent to F.A. Davis. Furthermore, all of the customer data F.A. Davis collects is protected against unauthorized access. All data stored on the DavisPTnetwork Site server(s) is stored in a database “behind” a secure firewall. There is no permissible access to the database outside of the hosted environment.

The information passed between the primary and continuing education sites is requiring HTTP authentication so the web services cannot be accessed from an external site without knowledge of the login and password.

F.A. Davis will not be saving any Payment Information upon completion of a transaction.

In general, all User passwords are asymmetrically encrypted and not unencryptable.

PERSONAL INFORMATION CONCERNS

If you have any concerns, questions or complaints regarding your Personal Information, the use of your Personal Information by F.A. Davis, or opting out of any communications from F.A. Davis, please send an email to customerservice@davisptnetwork.com. F.A. Davis will endeavor to address your concerns in a timely manner.
